ACCEPTANCE OF TERMS
Team Match provides services under the following Terms of Service ("TOS"). Our TOS may be updated from time to time, without prior notice to you. It is your responsibility to check the TOS periodically when you use this site to ensure that you agree and comply with the then current TOS. The current TOS and privacy policy constitute a legal agreement between you, the user, and Team Match.
DEFINITION OF THE SERVICE
Team Match provides OTR truck drivers with co-driver matching resources (hereinafter the "service"). The service is provided "AS-IS" and without warranty of any kink. While Team Match uses best practices to request valid information from our users, we assume no responsibility for the accuracy or validity of any information posted on this site originated by others, including, but not limited to users and advertisers.
WE CANNOT AND DO NOT SCREEN ALL POSTS NOR DO WE HAVE ANY WAY OF VERIFYING INFORMATION GIVE TO US BY USERS AND/OR ADVERTISERS. ALL USERS ARE CAUTIONED TO EXERCISE CAUTION WHEN GIVING PERSONAL INFORMATION TO PEOPLE YOU DO NOT KNOW OR WHEN POSTING PERSONAL INFORMATION IN A PUBLIC PLACE.
TERMS AND RESPONSIBILITIES
By using this service you certify that you hold a valid CDL and agree that any information you provide in completing your registration or otherwise on this site is true and correct. You further agree to update said information if it should change and to keep your profile on this site current and correct. If you have found a current match please set your status to inactive. If any information you provide is untrue, inaccurate or not current Team Match may, at it's sole discretion, terminate your membership or take such other action as it shall deem appropriate.
ACCOUNTS AND SECURITY
When you enroll in the service you will be given an account which will be secured by a password. You may change or update your password at any time. It is your responsibility to safe guard your password and you agree to assume full responsibility for use of your account. In the event that you lose your password or if you believe that your password has been compromised you are required to notify Team Match immediately and you will be given a new account and password and the old account will be terminated. You agree that you will be solely liable for any loss or damage arising from your failure to comply with this section.
CONDUCT OF MEMBERS
All members are required to take full responsibility for all information that they post and or upload to this site and you agree and represent that you, are entirely responsible for all Content that you upload, download, post, email, transmit or otherwise use or make available via the services on this site. You further acknowledge that Team Match cannot and does not guarantee the accuracy or legitimacy of any information posted on this site or provided to you by any other user/member or affiliate of this site.
It is your responsibility to conduct yourself in an honorable, sincere and legal manner and you agree that you will not intentionally post, email or otherwise convey any material that might be considered offensive, derogatory or harmful to another member. Further you agree that you will not use the service for any illegal endeavor and/or post any illegal material to your account.
Team Match takes abuse of this service very seriously and will immediately terminate the membership of any member who violates the TOS. If you feel another member has violated this agreement or has sent inappropriate information or communications to you please report the violation and Team Match will take appropriate action.
Finally, you agree that Team Match will not be liable for any content, including, but not limited to, any errors or omissions in any content, or for any loss or damage of any kind incurred as a result of the use of any content posted, emailed, transmitted or otherwise made available via this service.
Team Match reserves the right to terminate any membership for any reason at it's sole discretion. Any breach of conduct, illegal activity, or other inappropriate behavior will result in immediate termination of your account. Team Match also reserves the right to remove any content that in its opinion may be considered illegal, offensive or otherwise objectionable to other members.
PRIVACY POLICY
It is understood that Team Match is a service supported by our Trucking Company partners and you agree to allow such partners the right to contact you for the purpose of obtaining additional information from you and/or offering you prospective employment with their company. Other than this release of your private information, Team Match agrees not to sell or otherwise make you personal information known to any outside third party for any other purpose.
Team Match does not own any of the content which you submit. However, with respect to content you submit or make available on publicly accessible areas of the service, you grant us the license to use, distribute, reproduce, modify, adapt, publicly perform and publicly display such content as we deem appropriate.
We may preserve content at our sole discretion and we may also disclose such information to third parties to: (a) comply with legal process; (b) enforce the TOS; (c) respond to claims that any content violates the rights of third-parties; or (d) protect our rights, property, or personal safety or the rights, property and personal safety of our users and the public. We do not, however, undertake any affirmative obligation to examine content or disclose content to any third party for any reason.
You understand that due to the nature of the internet, your content may be transmitted over a number of networks and that people other than those on this site could gain access to it.
INDEMNITY
To the extent allowed by law you agree to indemnify and hold us, and our subsidiaries, affiliates, officers, agents, co-branders, sponsors, advertisers, attorneys or other partners, and employees, harmless from any claim or demand, direct or indirect losses of whatsoever nature including, but not limited to, consequential loss, economic loss, incidental, special or punitive loss, loss of profits, loss of business, loss of contracts, loss of revenue, loss of anticipated savings, loss of goodwill or loss of reputation, including attorneys' fees incurred by actions which you or any third party using your account are responsible for based on any information, or any content you submit, post, transmit or make available to us through the service.
TERMINATION
We may terminate your account at any time, if we believe it to be in our best interests or in the best interests of our users.
LINKS TO OTHER SITES AND/OR SERVICES
The service may provide, or third parties may provide, links to other WWW sites or resources. The existence of a link on our site does not imply an endorsement of that site or content thereon. You agree to be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any content, goods or services available on or through any such site or resource.
Any member posting links which are, in the sole discretion of Team Match, offensive to other members will be subject to immediate termination.
DISCLAIMER
YOU EXPRESSLY UNDERSTAND AND AGREE THAT (EXCEPT WHERE PROHIBITED BY LAW):
- YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
- WE MAKE NO WARRANTY THAT: (1) THE SERVICE WILL MEET YOUR REQUIREMENTS, (2) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (3) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE, (4) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS, AND (5) ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED.
- ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICE IS DONE AT YOUR OWN DISCRETION AND RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL.
- NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM US SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THE TOS.
LIMITATION OF LIABILITY
YOU EXPRESSLY UNDERSTAND AND AGREE THAT WE SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM THE USE OR THE INABILITY TO USE THE SERVICE OR ANY OTHER MATTER RELATING TO THE SERVICE.
COMPLETE AGREEMENT
The TOS constitute the entire agreement between you and Team Match and shall govern your use of the service, superseding any prior agreements between you and Team Match.
The section titles in the TOS are for convenience only and have no legal or contractual significance.
This service is copyrighted 2009 Team Match, and protected by US and international law. You agree not to reproduce, duplicate, copy, sell, resell or exploit for any commercial purposes, any of the information or services from our site.
